Mediation is a process which utilizes an experienced third party (the Mediator) to facilitate settlement of disputes. The Mediator does not decide which party prevails in the dispute. Nor does the Mediator decide issues.
Instead, the Mediator encourages the parties to participate in defining issues and collaborating to implement solutions. Mediation is often called a “win/win” process while litigation generally results in one party losing.
